ПРОБЛЕМНІ ПИТАННЯ ДОСЛІДЖЕННЯ УСНОГО МОВЛЕННЯ ОСОБИ ПРИ ПРОВЕДЕННІ ЛІНГВІСТИЧНОЇ ЕКСПЕРТИЗИ ТА ЕКСПЕРТИЗИ ВІДЕОЗВУКОЗАПИСІВ

Abstract

У статті розглянуто проблемні питання дослідження усного мовлення особи при проведенні двох видів судових експертиз. Автор проаналізував чинне законодавство України і дійшов висновку, що в законах відсутня класифікація судових експертиз, які є основною діяльністю мережі науково-дослідних експертних криміналістичних центрів. У статті розглянуто думки науковців щодо експертних досліджень усного мовлення особи. Вказано на розбіжності у класифікації судових експертиз в науці та підзаконних нормативних актах. Лінгвістична експертиза усного мовлення є підвидом лінгвістичної експертизи. Ототожнення людини за фізичними властивостями голосу є завданням експертизи відеозвукозапису. Розкрито зміст зазначених судових експертиз виходячи із тлумачення їх назв та аналізу завдань і об’єктів експертних досліджень. Досліджено компетенцію лінгвістичної експертизи усного мовлення та експертизи відеозвукозапису. Проведено порівняння слідів-відображень на матеріальних носіях, необхідних для проведення обох зазначених видів судових експертиз. Розглянуто потенційно негативні наслідки призначення двох послідовних судових експертиз в межах одного кримінального провадження. Автор дійшов висновку що лінгвістична експертиза усного мовлення та експертиза відеозвукозапису використовуючи однакові сліди-відображення на матеріальних носіях вирішують одні й ті ж питання, досліджуючи одне явище – усне мовлення людини – з різних сторін. Доведено необхідність запровадження комплексної соно-лінгвістичної експертизи яка б вирішувала тотожні ідентифікаційні, групофікаційні та діагностичні завдання, які нині ставляться перед лінгвістичною експертизою усного мовлення та експертизою відеозвукозапису. Предметом комплексної соно-лінгвістичної експертизи є індивідуальність мовлення окремої особи. Комплексна соно-лінгвістична експертиза повинна проводитись за участі експертів-лінгвістів та експертів, що мають спеціальні знання для проведення аналізу фізичних властивостей голосу. The article considers the problematic issues of the study of the oral speech of a person during two types of forensic examinations. The author analyzed the current legislation of Ukraine and came to the conclusion that the laws do not include the classification of forensic examinations, which are the main activity of the network of research forensic centers. The article considers the opinions of scientists on expert research on oral speech. The discrepancies in the classification of forensic examinations in science and by- laws are pointed out. Linguistic examination of oral speech is a subspecies of linguistic examination. The identification of a person by the physical properties of the voice is the task of examination of video and audio recording. The content of these forensic examinations is revealed based on the interpretation of their names and analysis of tasks and objects of expert research. The competence of linguistic examination of oral speech and examination of video and sound recording is investigated. The comparison of traces-reflections on material carriers necessary for carrying out of both specified types of forensic examinations is carried out. The potentially negative consequences of appointing two consecutive forensic examinations within one criminal proceeding are considered. The author came to the conclusion that linguistic examination of oral speech and examination of video and audio recording using the same traces-reflections on material carriers solve the same questions, investigating one phenomenon - human oral speech - from different sides. The necessity of the introduction of complex sono-linguistic examination which would solve identical identification, grouping, and diagnostic tasks which are now put before linguistic examination of oral speech and examination of video-sound recording is proved. The subject of complex sono-linguistic examination is the individuality of an individual's speech. The comprehensive sono-linguistic examination should be conducted with the participation of linguists and experts who have special knowledge to analyze the physical properties of the voice.
